
One of the men Shia LaBeouf allegedly assaulted and verbally harassed with homophobic slurs during Mardi Gras morning in New Orleans on Tuesday, leading to his arrest, wants the actor prosecuted for a hate crime.
Jeffrey Damnit, who was dressed as a drag queen and in makeup at the time of his encounter with LaBeouf, said Thursday that the actor's behavior was "a slap in the face to any person in the alternative culture."
He said he hoped New Orleans' most famous city prosecutors would pursue charges under the state's hate crime law, which allows enhanced penalties for anyone found to have caused "actual or perceived" harm based on a victim's sex or gender, among other categories.
"Because of his fame, if he gets off with a slap on the wrist, anyone who looks up to him or even knows him will think it's OK to do the same thing," Damnit said, two days after LaBeouf was ordered released from custody without bail.
"They'll think you can call someone a 'faggot,' hit them a few times, get a free room for the night, and be back partying by the afternoon of the next day."
LaBeouf was approached for comment Thursday about the allegations against him. "Get your ass out of here, you stupid boy," he said.
Those were apparently his first comments since his arrest, which was connected to R Bar in New Orleans' Marigny neighborhood, according to police reports that allege he struck Damnit and another man, repeatedly insulting them with the word "faggot."
The Guardian, which saw video of LaBeouf using the slur during his arrest, has tried multiple times to reach the actor and his representatives for comment on the allegations against him. They have not responded or declined to comment, so The Guardian approached LaBeouf at a New Orleans home address listed for him in a police report generated by his arrest.
LaBeouf's front door was wide open when a Guardian reporter, equipped with a press badge, pen and notebook, arrived at the address. The actor was speaking with a locksmith. The two men soon stepped outside, and LaBeouf asked "What's up with you?" as he realized the reporter was standing in his small front yard.
After being given the opportunity to respond to the allegations against him, LaBeouf pointed, as if shooing the reporter away, and said "Get your ass out of here, you stupid boy." He then yelled "Yeah — I'm Shia LaBeouf" as the reporter complied with his request to leave.
According to police reports, LaBeouf grew increasingly aggressive at R Bar on the day of his arrest, which is a short walk from New Orleans' famous French Quarter.
Court documents indicated LaBeouf attempted to strike the bar manager who was trying to eject him from the premises. After being ejected, LaBeouf allegedly struck 49-year-old Damnit — who was helping the bar manager — in his upper body.
LaBeouf then returned and struck 34-year-old Nathan Thomas Reed in the nose, though the latter said he did not want to fight, officers reported in the police report. The police report noted LaBeouf repeatedly targeted the word "faggot" at Reed and Damnit.
Damnit, an actor and frequent visitor to New Orleans from Los Angeles, was in drag and wearing mascara, eyeshadow and lipstick at the time of his encounter with LaBeouf. Social media images show Damnit — whose last name is Klein — celebrating Mardi Gras in drag.
On the other hand, Reed says he identifies as queer.
Eventually, bystanders tackled LaBeouf to the ground before police and ambulances arrived, officers reported. He was taken to a hospital, released, and then arrested on two counts of simple battery.
After being released from custody, LaBeouf was seen partying on Bourbon Street during New Orleans' Mardi Gras revelry. He had Mardi Gras beads around his neck and at one point held his release papers in his mouth.
LaBeouf has had previous run-ins with criminal and civil courts. During a 2017 arrest that stemmed from a court-mandated rehab session, LaBeouf recorded himself calling police officers racist and saying a black officer was going to hell.
During an arrest in 2014 on New York City's Broadway, LaBeouf was charged with using homophobic slurs toward a police officer.
